These Terms of Use (the "Terms") govern your access to and use of the website operated by North Cast Inc. ("North Cast," "we," "us," or "our"), available at https://northcast.us (the "Site"). By accessing, browsing, or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree with any of these Terms, you must immediately cease using the Site. We may update these Terms at any time, and such changes take effect upon publication on the Site.
North Cast Inc. is a U.S.-based trading company specializing in the sourcing and supply of engineered steel and brass castings and machined components. North Cast works on a build-to-print basis, meaning every part is made to the customer's drawing and specification, with products manufactured by ISO 9001:2015–certified manufacturing partners and produced to ASTM and AISI standards. The Site is provided for informational, commercial, and business development purposes related to our products and services.
The Site is intended for use by individuals and entities that are legally capable of entering into binding contracts. By using the Site, you represent and warrant that: (a) you are at least 18 years of age or the age of majority in your jurisdiction; (b) you have the legal authority to enter into these Terms on your behalf or on behalf of any entity you represent; (c) you will use the Site solely for lawful business, informational, or professional purposes; and (d) all information you provide is accurate, complete, and current.

All content, materials, designs, graphics, photographs, text, software, and other elements displayed on or accessible through the Site (the "Content") are the property of North Cast Inc. or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. The "North Cast" name, logo, and any related trademarks, service marks, and trade names are trademarks of North Cast Inc., whether registered or unregistered. Nothing on the Site grants, by implication or otherwise, any license or right to use any trademark displayed on the Site without our prior written permission.
You may view and print Content from the Site for your personal, non-commercial informational use or for legitimate business purposes related to a current or prospective relationship with North Cast, provided you do not modify the Content, remove any proprietary notices, or use it in a way that suggests association with any product, service, or brand other than North Cast.
North Cast respects the intellectual property rights of others and expects the same from users of the Site. If you believe that any content on the Site infringes your copyright, trademark, or other intellectual property rights, please submit a written notice to sm@northcast.us including: (a) identification of the work or right you claim is being infringed; (b) identification of the material on the Site you claim is infringing, including its specific URL or location; (c) your contact information (name, address, telephone number, and email); (d) a statement that you have a good-faith belief that the use is not authorized by the intellectual property owner, its agent, or the law; and (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner of the right at issue or are authorized to act on the owner's behalf.
Upon receiving a complete and valid notice, North Cast will promptly and in good faith investigate the claim and, where warranted, remove or disable access to the identified material while the matter is resolved. We reserve the right to request additional information before taking action and to reject claims that are incomplete, unsubstantiated, or submitted in bad faith.
The Site allows you to submit information through various forms, including Request for Quote (RFQ) and contact forms (collectively, "Submissions"). By making a Submission, you represent and warrant that: (a) the information is accurate, complete, and current; (b) you have the legal right to provide such information; and (c) the Submission does not violate any third-party rights, including intellectual property, privacy, or contractual rights.
North Cast will treat personal data contained in Submissions in accordance with our Privacy Policy. Submissions are not considered confidential unless expressly marked and acknowledged as such in writing by North Cast; technical drawings or specifications submitted with a quote request are treated with commercially reasonable care, but you should not submit material requiring a formal confidentiality agreement unless one is already in place with us. We reserve the right, but assume no obligation, to review or decline any Submission at our sole discretion.
North Cast is a supply company, so quoting and producing a part requires a manufacturing partner. We review your Submission ourselves first and use that review to identify the partner best suited to the part. We then disclose to that partner the drawings, specifications, and technical details required to quote and produce it, along with the contact details needed to raise technical questions. Your Submission is not circulated among partners who are not being considered for the work, and the partner we select receives it for that purpose alone. By making a Submission you authorize that disclosure.
Product descriptions, capabilities, and specifications on the Site are provided for general informational purposes only. Submitting a request for quote does not create a binding offer or contract. Final pricing, specifications, delivery, and all other commercial terms are governed exclusively by a written quotation or purchase agreement between you and North Cast. We may modify or discontinue any product, service, or specification without notice.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. NORTH CAST DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTH CAST INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, UNDER ANY LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless North Cast Inc. and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any Submission you make through the Site.
The Site may contain links to third-party websites or services. North Cast does not control or endorse third-party content and assumes no responsibility for it. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.
We may update these Terms or modify, suspend, or discontinue the Site (or any part of it) at any time, at our sole discretion and without notice or liability to you. Changes to these Terms take effect when posted on this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
As a supplier of engineered industrial components, North Cast's products and services may be subject to U.S. export control and trade compliance laws, including the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC). You agree to comply with all applicable export, re-export, and trade compliance laws in connection with any product obtained from North Cast, and you represent that you are not located in, or a resident or national of, any country or territory subject to comprehensive U.S. sanctions, and that you are not included on any list of restricted or prohibited parties maintained by competent authorities.
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, store, and protect personal data, including under the California Consumer Privacy Act (CCPA/CPRA) and the European Union General Data Protection Regulation (GDPR) where applicable.
North Cast shall not be liable for any failure or delay in performance under these Terms or in the operation of the Site to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, labor disputes, governmental action, or internet, telecommunications, or power failures.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other legal notices we publish on the Site, constitute the entire agreement between you and North Cast concerning your use of the Site, and supersede any prior communications or representations. These Terms do not govern any commercial agreement for the purchase or supply of products, which is subject to a separate written quotation or purchase agreement between the parties.
These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law principles.
